Terms of Use

These Terms of Use govern your access to and use of the website quenarafoundation.com, the Quenara Foundation donor portal, and all related services. Quenara Foundation is the humanitarian aid brand operated by No Name Foundation, a 501(c)(3) tax exempt nonprofit organization based in Dover, Delaware, USA (EIN: 35-2882867). By accessing or using our website, creating a donor account, or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By using quenarafoundation.com you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), have read and understood these Terms of Use, our Privacy Policy, our Cookie Policy, and accept them in full. These Terms form a binding agreement between you and No Name Foundation.

2. About Quenara Foundation

Legal entity: No Name Foundation, a Delaware nonprofit corporation recognized as tax exempt under Section 501(c)(3) of the Internal Revenue Code. EIN: 35-2882867. Registered address: Dover, Delaware, USA.

Quenara Foundation is the operating brand under which No Name Foundation conducts international humanitarian aid in 48 countries facing acute crisis (Sudan, Somalia, Yemen, Afghanistan, Bangladesh, Mali, Chad, DR Congo, South Sudan, Lebanon, Palestine, Haiti, and others). Programs include emergency aid, food security, water wells, orphan sponsorship, education, health, winter relief, and faith based fund categories (Zakat, Sadaqah, Qurbani, Ramadan iftar).

3. Eligibility

To create a donor account or make a donation you must:

  • Be at least 18 years of age or have valid consent from a parent or legal guardian,
  • Have the legal capacity to enter into a binding contract under the laws of your country of residence,
  • Not be located in or acting on behalf of a person or entity subject to United States, European Union, United Nations, or other applicable sanctions,
  • Provide accurate, current, and complete information when creating an account or making a donation,
  • Use the website and donor portal only for lawful purposes consistent with these Terms.

4. Donation Terms

4.1 Types of Donations

We accept one time donations and recurring (monthly) donations through Stripe payment processing in multiple currencies (USD, EUR, GBP, TRY, AED, CAD, AUD, and others as supported). You may direct donations to specific funds (Emergency Aid, Water Wells, Orphan Sponsorship, Education, Health, Food, Winter Aid, Mosque, Animal Welfare, Environment, Disaster, Qurbani, Ramadan, Zakat, Sadaqah, General).

4.2 Tax Deductibility

No Name Foundation is recognized by the IRS as a 501(c)(3) tax exempt public charity. Contributions are deductible to the fullest extent permitted under Internal Revenue Code Section 170(c)(2) for United States donors. Donors outside the United States should consult their local tax advisor regarding charitable contribution treatment in their jurisdiction.

4.3 Donation Receipts (IRS Publication 1771)

For every donation we issue a contemporaneous written acknowledgment compliant with IRS Publication 1771 and IRC Section 170(f)(8). The receipt includes:

  • Name of the organization (No Name Foundation),
  • EIN: 35-2882867,
  • Date and amount of contribution,
  • Statement that no goods or services were provided in exchange (except for permitted token benefits, if any),
  • Description and good faith estimate of any goods or services provided,
  • Statement of tax exempt status under IRC Section 501(c)(3).

Receipts are delivered via email immediately after a successful donation and are also available from your donor dashboard.

4.4 Currency and Exchange Rates

Donations are processed in the currency you select at checkout. Stripe applies the exchange rate at the time of authorization and converts the amount to United States Dollars on our settlement statement. The USD equivalent recorded on your receipt represents the federal tax deductible value per IRS guidance on foreign currency conversion.

4.5 Recurring Donations

If you authorize a recurring donation, your selected amount will be charged on the same calendar day each month until you cancel. You may pause, modify, or cancel a recurring donation at any time from your donor dashboard at /my-account/ or by contacting privacy@quenarafoundation.com. Cancellation takes effect for future scheduled charges and does not retroactively refund prior donations.

4.6 Restricted Funds

When you designate a donation to a specific fund (for example “Water Wells”), we will use that contribution for the designated purpose. If the designated program is fully funded, oversubscribed, or operationally infeasible, the Board of No Name Foundation reserves the right under variance power (Treasury Regulation 1.170A 9(f)(11)(v)) to redirect the donation to a substantially similar program. Donors will be notified through annual transparency reports.

5. Refund Policy

5.1 Refund Eligibility

Charitable donations are generally non refundable once processed. However we recognize that mistakes happen. You may request a refund under the following conditions:

  • Within 30 days of donation: Full refund available for donations that have not yet been allocated to a field program. Contact privacy@quenarafoundation.com with your receipt number.
  • Duplicate or unauthorized charges: Full refund regardless of time elapsed, subject to verification.
  • Recurring donation made in error: Refund of the unintended charge plus immediate cancellation of the schedule.
  • Fraudulent transaction: Reported within 60 days, full refund after investigation.

5.2 Refund Processing

Approved refunds are processed through Stripe to the original payment method within 5 to 10 business days. The corresponding donation receipt is voided and removed from your tax records. We may decline a refund if the donated funds have already been irrevocably committed to a beneficiary program in the field.

5.3 Disputes and Chargebacks

If you initiate a payment dispute with your card issuer or bank, please contact us first so we can resolve the issue directly. Chargebacks not preceded by direct contact may result in your donor account being suspended.

6. Intellectual Property

All content on quenarafoundation.com, including text, images, photographs, video, audio, logos, trademarks, project names, the Quenara brand identity, design elements, code, and software is the property of No Name Foundation or its content suppliers and is protected by United States and international copyright, trademark, and intellectual property laws.

You may view, download, and print pages for your personal, non commercial use of learning about our humanitarian work. You may share our content on social media with proper attribution to Quenara Foundation. You may not:

  • Reproduce, distribute, modify, or publicly display our content for commercial purposes without prior written consent,
  • Use our trademarks, logos, or brand identity to suggest endorsement or affiliation without permission,
  • Scrape, harvest, or systematically extract data from our website using automated tools,
  • Frame, mirror, or deep link our donor portal pages on third party sites without consent.

7. User Conduct

When using our website and donor portal you agree NOT to:

  • Impersonate any person, entity, or organization, or misrepresent your affiliation,
  • Submit false, misleading, or fraudulent donation or account information,
  • Use the donor dashboard or help desk to harass, threaten, or harm other users or staff,
  • Attempt to gain unauthorized access to other accounts, our servers, or restricted areas,
  • Upload malware, viruses, worms, or any code designed to disrupt our systems,
  • Interfere with the proper operation of the website (denial of service attacks, exploitation of vulnerabilities),
  • Use the platform for money laundering, terrorism financing, sanctions evasion, or any unlawful purpose,
  • Submit content that infringes intellectual property, privacy, or publicity rights of others.

Violation may result in immediate account suspension, refund denial, legal action, and notification to law enforcement.

8. Our Commitments

We commit to:

  • Use donated funds for the designated humanitarian programs subject to variance power for substantially similar use,
  • Issue IRS Publication 1771 compliant donation receipts for every contribution,
  • Maintain transparent annual reports showing program allocation and operational expenses,
  • Protect personal data in accordance with our Privacy Policy and applicable data protection law,
  • Operate under variance power so that no donation is lost if the designated program is completed,
  • Notify donors of material changes to these Terms with at least 14 days notice.

9. Disclaimers and Limitations

9.1 Website Availability

We strive to keep our website available 24 hours a day, but we do not guarantee uninterrupted access. The website may be temporarily unavailable due to maintenance, software updates, hardware failures, or events beyond our reasonable control. We are not liable for any inconvenience or loss caused by such interruptions.

9.2 No Warranty

The website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non infringement, or accuracy of information. We do not warrant that the website will be error free, secure, or free from viruses.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, No Name Foundation, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the website or donation services, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising from these Terms or the website shall not exceed the amount you donated in the 12 months preceding the claim.

9.4 Field Operations Beyond Our Control

Humanitarian operations in crisis zones involve risks beyond our control, including but not limited to armed conflict, natural disasters, government action, sanctions, logistics failures, and access restrictions. We make best efforts to deliver aid but cannot guarantee delivery timelines or quantities in every circumstance. Where a designated program cannot be executed, variance power applies (Section 4.6).

10. Indemnification

You agree to indemnify, defend, and hold harmless No Name Foundation, its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with:

  • Your violation of these Terms,
  • Your misuse of the website or donor portal,
  • Your violation of any law or regulation,
  • Your infringement of any third party right.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12. Dispute Resolution

Before initiating any formal legal action, you agree to first contact privacy@quenarafoundation.com with a detailed description of the dispute. We will work in good faith to resolve the matter within 60 days. If informal resolution fails, disputes may be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the arbitration seat in Delaware, USA, in the English language. The class action waiver in this section does not apply where prohibited by law.

13. Termination

We may suspend or terminate your donor account at any time for violation of these Terms, suspected fraud, sanctions screening hits, or for other operational reasons with reasonable notice. You may close your account at any time by emailing privacy@quenarafoundation.com. Account closure does not affect donation records, which we retain for the period required by IRS regulations (seven years).

14. Changes to These Terms

We may update these Terms of Use from time to time. When we make material changes we will:

  • Post the revised Terms on this page with a new “Last Updated” date,
  • Notify registered donors by email at least 14 days before the change takes effect,
  • Where required by applicable law, seek your renewed agreement to the changes.

Your continued use of the website after the effective date constitutes acceptance of the revised Terms.
